Balance Payment and Booking Terms

Christmas and New Year Period

• Bookings made more than 120 days before arrival :
  • Deposit: 30% of the rent, payable within 5 to 10 days after booking acceptance.
  • Balance: Remaining 70% due at least 120 days before arrival.
• Bookings made within 120 days or less before arrival :
  • Full payment: 100% of the rent, payable within 5 to 10 days after booking acceptance and before arrival.

Other Periods

• Bookings made more than 60 days before arrival :
  • Deposit: 30% of the rent, payable within 5 to 10 days after booking acceptance.
  • Balance: Remaining 70% due at least 60 days before arrival.
• Bookings made 60 days or less before arrival :
  • Full payment: 100% of the rent, payable within 5 to 10 days after booking acceptance and before arrival.

Check-in and Check-out Times

• Check-in time : 3:00 PM (unless prior written agreement from the agency).
• Check-out time : 11:00 AM (unless prior written agreement from the agency).

Occupancy Conditions

• The number of booked rooms and authorized guests in the villa are determined based on the initial agreement and payment, generally calculated on the basis of two people per room.
• If a group arrives with more people than originally planned, an immediate payment for each additional person is required. Failing this, the group must leave the property without a refund.
• An exception may be granted for young children, provided they only use a crib.

Security Deposit

• A sum will be held as a guarantee to cover any potential damages to the villa or additional charges.
• This amount will be refunded to the client within 30 days after departure, provided no damages are found on the property.
• In case of damages, the tenant authorizes the agency to deduct the necessary amounts to cover the repairs.
• The tenant must report any damage observed upon arrival.

Valuable Items

• The tenant’s personal belongings, as well as those of other occupants of the property, remain their sole responsibility.
• Valuable items should be stored in the safes provided for this purpose.
• Neither the agency nor the owner can be held responsible for any loss, damage, or theft of these items or personal belongings.

Insurance

• It is recommended to take out insurance (travel insurance, homeowner’s insurance, etc.) to protect against unforeseen events or delays that may disrupt, delay, or cancel travel plans.
• Adequate coverage must be secured at the time of booking.
• By signing the registration form, the client acknowledges awareness of these insurance options and confirms having obtained appropriate coverage for this booking.

Cancellation Policy

General Cancellation Terms

• These conditions apply only if deposits and balances have been credited to the agency’s bank account.
• Any cancellation request must be submitted in writing to the agency.
• The total amount of the stay must be paid in case of no-show on the scheduled arrival date or any modification to the reservation (e.g., reduction in the number of occupants or early departure).

Christmas and New Year Period

• Cancellation 91 days or more before arrival :Cancellation fee:  30% of the gross rental amount.
• Cancellation between 90 and 61 days before arrival : Cancellation fee: 50% of the gross rental amount.
• Cancellation 60 days or less before arrival : Cancellation fee: 100% of the gross rental amount.

Outside Christmas and New Year Period

• Cancellation 61 days or more before arrival :Cancellation fee:  30% of the gross rental amount.
• Cancellation between 60 and 31 days before arrival : Cancellation fee: 50% of the gross rental amount.
• Cancellation 30 days or less before arrival : Cancellation fee: 100% of the gross rental amount.

Modification or Cancellation by Art de Vivre Villas

• If Art de Vivre Villas is forced to modify a confirmed booking for reasons beyond its control, clients will be informed as soon as possible.
• Transfer to an alternative property : If Art de Vivre Villas cannot provide the reserved villa, it reserves the right to relocate the client to an equivalent villa.
• Cancellation and refund : If no transfer is possible or if the client refuses the transfer, Art de Vivre Villas will cancel the reservation and refund the amount paid for the villa.
• Liability : Art de Vivre Villas will not be held responsible for travel cancellation fees under any circumstances.

Villa Change During the Stay

• A villa change during the stay is only allowed in cases of force majeure, such as :
  • Noisy construction work nearby significantly impacting the rental.
  • A major technical issue rendering the property uninhabitable.
• Any change will be decided and implemented by Art de Vivre Villas, depending on availability on the island.

Claims and Legal Aspects

General Cancellation Terms

• • Immediate Notification : The tenant must inform the agency as soon as a problem arises in the villa during their stay.
  • Claims : Only complaints reported to the agency during the stay will be considered.

Legality and Jurisdiction

• • Applicable Law: The tenant agrees that this contract is governed by and interpreted under French law for any action against the agency.
  • Jurisdiction : In the event of a dispute, the Tribunal of Basse-Terre in Guadeloupe has jurisdiction.

Mediation

• If a dispute is not resolved amicably, the consumer may contact a consumer mediator within one year, in accordance with Articles L611-1 to L641-1 and R612-1 to R616-2 of the French Consumer Code.
